By downloading, installing, or using TimeStamp! or Draftable (each an "App," collectively the "Apps"), you agree to be bound by these Terms of Use ("Terms"). These Terms apply to all versions of the Apps, including future updates. If you do not agree, do not use the Apps.
The Apps are provided by Andrew Maxwell, doing business as Andrew Maxwell ("Andrew Maxwell," "we," "us," or "our"), an independent developer based in California.
You must be at least 13 years old to use the Apps. If you are between 13 and 18 years old, you may only use the Apps with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. We do not knowingly collect personal information from children under 13.
Andrew Maxwell grants you a limited, non-exclusive, non-transferable, revocable license to use the Apps for personal, non-commercial purposes on Apple-branded devices you own or control, subject to these Terms and the Apple App Store Terms of Service.
You may not:
TimeStamp! — The app accesses your device's photo library to read timestamp metadata (the date photos were taken). This access is used solely to generate gameplay. Your photos are never uploaded or transmitted. You may revoke photo access at any time via iOS Settings.
Draftable — The app connects players in real-time game sessions via Firebase. Player names, draft picks, and votes are temporarily stored to enable multiplayer gameplay and are automatically deleted after 3 hours. By participating in a game, you acknowledge that your display name and picks will be visible to other players and anyone who receives the poll link.

The Apps are currently free to download and use. If we introduce in-app purchases in the future, they will be clearly labeled, processed through the Apple App Store, and non-refundable except as required by applicable law or Apple's refund policies.
All content, features, and functionality of the Apps — including but not limited to text, graphics, logos, icons, audio, and software — are owned by or licensed to Andrew Maxwell and are protected by intellectual property laws. "TimeStamp!", "Draftable," and "Andrew Maxwell" are trademarks of Andrew Maxwell and may not be used without prior written consent.
The Apps integrate with third-party services including Firebase (Google), Apple Game Center, and Apple App Store. Your use of these services is governed by their respective terms and privacy policies. Andrew Maxwell is not responsible for the practices of any third-party service providers.
Andrew Maxwell may suspend or terminate your access to the Apps at any time, without notice, for conduct that violates these Terms or is harmful to other users, us, or third parties. You may stop using the Apps at any time by deleting them from your device. Sections 7, 9, 10, 12, and 13 survive any termination.
If you have a dispute with Andrew Maxwell, please contact us first at support@timestampgames.com. We will attempt to resolve any dispute informally within 30 days.
If informal resolution fails, any dispute, claim, or controversy arising out of or relating to the Apps or these Terms shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, and not in court. You and Andrew Maxwell each waive any right to a jury trial and to participate in a class action, class arbitration, or representative action.
Arbitration proceedings will be conducted in California, unless otherwise required by the AAA rules for in-person proceedings.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law provisions. Any dispute not subject to arbitration shall be resolved in the state or federal courts located in California.
We may update these Terms from time to time. We will notify you of material changes by updating the "Effective Date" at the top of this page. Your continued use of the Apps after the effective date of any changes constitutes your acceptance of the revised Terms.
