Terms of Use
1. Acceptance of Terms
By downloading, installing, or using TimeStamp! or Draftable (each an "App," collectively the "Apps"), you agree to be bound by these Terms of Use ("Terms"). These Terms apply to all versions of the Apps, including future updates. If you do not agree, do not use the Apps.
The Apps are provided by Andrew Maxwell ("Andrew Maxwell," "we," "us," or "our"), an independent developer based in California.
2. Eligibility & Age Requirements
You must be at least 13 years old to use the Apps. If you are between 13 and 18 years old, you may only use the Apps with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. We do not knowingly collect personal information from children under 13.
3. License to Use the Apps
Andrew Maxwell grants you a limited, non-exclusive, non-transferable, revocable license to use the Apps for personal, non-commercial purposes on Apple-branded devices you own or control, subject to these Terms and the Apple App Store Terms of Service.
You may not:
- Sell, sublicense, rent, or lease the Apps or any portion thereof
- Copy, modify, adapt, translate, or create derivative works of the Apps
- Reverse engineer, disassemble, or decompile the Apps
- Use the Apps for any commercial purpose without our written permission
- Remove or obscure any proprietary notices in the Apps
4. App-Specific Terms
TimeStamp! — The app accesses your device's photo library to read timestamp metadata (the date photos were taken). This access is used solely for gameplay. In solo and Daily games, photos stay on your device. In Party Mode, small thumbnails of the round's photos are shared with the other players in your room, as described in the TimeStamp! Privacy Policy. Only play Party Mode with photos you're comfortable sharing. You may revoke photo access at any time via iOS Settings.
Draftable — The app connects players in real-time game sessions via Firebase. Player names, draft picks, and votes are temporarily stored to enable multiplayer gameplay. Game rooms are deleted about 3 hours after they're created and poll results within 30 days. By participating in a game, you acknowledge that your display name and picks will be visible to other players and anyone who receives the poll link.
Nametags — A party game for adults (18 or older and of legal drinking age where you play), played in person at bars and other venues. Crew names, player names, the first names and notes you log for people you meet, and optional photo proof are shared with your crew and stored until the game has been inactive for 36 hours, as described in the Nametags Privacy Policy. Additional terms for Nametags are in Section 5c.
Fifty — A social prediction game for adults (18 or older) that uses play money only. Group names, first names, markets, and picks are shared with the members of your group and stored with Google Firebase, as described in the Fifty Privacy Policy. Additional terms for Fifty are in Section 5d.
5. Prohibited Conduct
When using the Apps, you agree not to:
- Violate any applicable law or regulation
- Use the Apps to harass, abuse, or harm other users
- Submit false, misleading, or offensive content as picks, player names, or votes
- Attempt to gain unauthorized access to any App system, server, or database
- Use automated bots, scripts, or tools to interact with the Apps
- Interfere with or disrupt the Apps or servers connected to them
- Cheat, exploit bugs, or manipulate game results
5a. Your Content
You are responsible for the names, picks, custom categories and prices you enter. Don't enter content that is unlawful, hateful, harassing, sexually explicit about real people, or that shares anyone's personal information. We may remove content or restrict access for users who break these rules. Report offensive content or abuse to andrewgmaxwell123@gmail.com.
5b. Draftable After Dark (21+)
The optional After Dark pack in Draftable contains adult party categories and is intended only for users 21 and older. By purchasing or playing After Dark categories you confirm you are at least 21. Categories are conversation prompts only and do not encourage illegal activity.
5c. Nametags: Age, Safety, and Real-World Conduct
Nametags is only for people who are 18 or older and of legal drinking age where you play. By using it, you confirm you meet both requirements. If you're under the legal drinking age where you are, don't play. The game is about meeting people, and nothing in it requires alcohol: any quest that mentions a drink can be completed with a non-alcoholic one.
Nametags suggests conversation-starting quests. Every quest is optional, and the game is meant to be played in a friendly, respectful way. When you play, you agree to:
- Respect everyone's boundaries. Only interact with people who are happy to talk. If someone isn't interested, or says no at any point, stop and move on. Anything physical, including quests that mention it, requires the other person's clear, enthusiastic consent.
- Never pressure, follow, harass, or mislead anyone to complete a quest or win points.
- Only photograph people with their permission, and only log first names and non-sensitive notes.
- Drink responsibly or not at all. Never drive impaired. Follow the law and each venue's rules.
- Look out for yourself and your friends. Meet new people in public, and let a friend know where you're going if you leave with someone.
Pro features. In Crew vs. Crew and every other mode, points are for fun and have no cash value. Bar Crawl mode is optional: plan how you get between bars before you start drinking, and never drive impaired. Quests you write yourself are your content under Section 5a, and you're responsible for making sure they follow these rules. Don't write quests that target a specific real person, pressure anyone, or involve anything unsafe or illegal.
You are solely responsible for your own actions, choices, and interactions while playing, including with people you meet. We don't screen or supervise anyone you meet, and we aren't responsible for the conduct of other players or third parties. You play at your own risk. To the fullest extent permitted by law, the disclaimers and limitations in Sections 9 and 10 apply to any injury, loss, or dispute arising from in-person activity connected with Nametags.
5d. Fifty: Play Money Only, Age, and Fair Play
Fifty does not involve real money. Fifty is a game. The dollar amounts shown in Fifty are pretend points ("play money"). Play money is free, has no cash value, and cannot be purchased, cashed out, withdrawn, redeemed, transferred, traded, sold, or exchanged for money, goods, services, or anything else of value. No prizes of any kind are awarded. Nothing in Fifty is a wager. Fifty is not gambling, a casino, a sportsbook, a lottery, a sweepstakes, or a real-money prediction market, and it is not a financial product. Arranging any real-money stakes, side bets, or prizes based on Fifty outside the app is against these Terms.
You must be 18 or older to use Fifty. By using it, you confirm that you are and that using it is legal where you live.
- Settling. Only the person who opens a market can settle it. We don't decide, verify, or arbitrate outcomes. If your group disagrees about a result, that's between you and your friends.
- Markets about people. Keep them friendly. Don't open markets that harass, embarrass, or target anyone; that are sexual about a real person; that involve minors, self-harm, violence, illegal acts, or anything dangerous; or that encourage someone to do something unsafe to "make it happen."
- Picks on yourself. You can't make picks on a market about yourself. The person a market is about can take it down at any time, and everyone's play money is refunded.
- Reports and blocks. You can report markets and block people in the app. We may remove content and block access for anyone who breaks these rules.
- Real-world conduct. What you and your friends do in real life is your responsibility. Never put yourself or anyone else at risk over a market.
6. In-App Purchases and Subscriptions
The Apps are free to download. Some features are available through optional in-app purchases, processed by Apple through the App Store.
Draftable Pro is an auto-renewable subscription priced at $1.99 per week (or the local equivalent shown in the app). Payment is charged to your Apple ID at confirmation of purchase. The subscription renews automatically unless canceled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the period ends. You can manage or cancel your subscription in your App Store account settings. Pro features unlocked by a subscribed host are available to other players only while they are in that host's room.
Nametags Pro is an auto-renewable subscription available monthly ($4.99 per month) or yearly ($29.99 per year), or the local equivalent shown in the app. Payment is charged to your Apple ID at confirmation of purchase. The subscription renews automatically unless canceled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the period ends. You can manage or cancel your subscription in your App Store account settings. A Day Pass ($0.99) is a one-time purchase that unlocks Pro for one crew for one night and does not renew. Pro unlocked by a subscriber or Day Pass holder applies to everyone in that crew's game only while they're in it. Free months of Pro earned by bringing new players into the game are a promotional perk: they have no cash value, can't be transferred, are counted on the host's phone, and may be changed or ended at any time.
Fifty Pro is an auto-renewable subscription available weekly ($0.99 per week) or yearly ($19.99 per year), or the local equivalent shown in the app. It unlocks app features only: more open markets, larger groups, secret markets, and longer markets. Fifty Pro never buys play money, picks, odds, or prizes, and does not change anyone's chances. Payment is charged to your Apple ID at confirmation of purchase. The subscription renews automatically unless canceled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the period ends. You can manage or cancel your subscription in your App Store account settings. Larger group sizes unlocked by a group's creator apply to that group.
Purchases are non-refundable except as required by applicable law or Apple's refund policies. Your use of the Apps is also subject to Apple's Standard End User License Agreement.
7. Intellectual Property
All content, features, and functionality of the Apps — including but not limited to text, graphics, logos, icons, audio, and software — are owned by or licensed to Andrew Maxwell and are protected by intellectual property laws. Other names, brands and trademarks that appear in the Apps (including the names of athletes, teams, leagues, shows, products and companies used in categories) belong to their respective owners and are used only to identify them. The Apps are not affiliated with, sponsored by, or endorsed by any of them.
8. Third-Party Services
The Apps integrate with third-party services including Firebase (Google), Apple Game Center, and Apple App Store. Your use of these services is governed by their respective terms and privacy policies. Andrew Maxwell is not responsible for the practices of any third-party service providers.

Andrew Maxwell may suspend or terminate your access to the Apps at any time, without notice, for conduct that violates these Terms or is harmful to other users, us, or third parties. You may stop using the Apps at any time by deleting them from your device. Sections 7, 9, 10, 12, and 13 survive any termination.
12. Dispute Resolution & Arbitration
If you have a dispute with Andrew Maxwell, please contact us first at andrewgmaxwell123@gmail.com. We will attempt to resolve any dispute informally within 30 days.
If informal resolution fails, any dispute, claim, or controversy arising out of or relating to the Apps or these Terms shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, and not in court. You and Andrew Maxwell each waive any right to a jury trial and to participate in a class action, class arbitration, or representative action.
Arbitration proceedings will be conducted in California, unless otherwise required by the AAA rules for in-person proceedings.
13. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law provisions. Any dispute not subject to arbitration shall be resolved in the state or federal courts located in California.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Effective Date" at the top of this page. Your continued use of the Apps after the effective date of any changes constitutes your acceptance of the revised Terms.
